The agreement between you and BuildersLink when you use our marketplace.

About these terms and your acceptance

These Terms & Conditions ("Terms") govern your use of the BuildersLink website and application (the "Platform"). By creating an account or signing up to the Platform, you agree to these Terms. Acceptance is given electronically, and under the Contract and Commercial Law Act 2017 that electronic acceptance is as valid as a signature on paper. If you don't agree to these Terms, please don't use the Platform.

Definitions

In these Terms: "BuildersLink", "we", "us" means the operator of the Platform; "customer" means a person who posts or seeks work; "tradie" means a tradesperson or business offering services; "user" means anyone who uses the Platform; and a "job" means work a customer and a tradie arrange through the Platform.

Eligibility and your account

You must be at least 18 years old and able to enter a binding contract to use the Platform. You're responsible for the accuracy of your account details, for keeping your login secure, and for activity that happens under your account. Tradies must hold the licences, registrations, insurance and consents required for the work they offer.

Our role — a marketplace, not a party to your job

BuildersLink is a marketplace intermediary that connects customers with tradies. We are not a party to the contract for any job — that contract is solely between the customer and the tradie, who are responsible for agreeing scope, price, timing, quality and payment between themselves. We don't carry out the work and we don't supply the tradie's services. See our Disputes & Liability page for more.

Your obligations

You agree to use the Platform lawfully and honestly, to provide accurate information, and to follow our Code of Conduct. You must not misuse the Platform, interfere with its operation, or use it to deceive, harass, or harm others.

Fees and Pro plan

Posting a job and receiving matches is free for customers. Tradies may subscribe to a paid plan — see our Pricing page for current plans and what they include. Fees are payable as described there, and we'll tell you before any charge applies.

Intellectual property and licence

The Platform, including its branding, design and content, is owned by BuildersLink or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose. Content you submit remains yours, but you grant us a licence to host, display and use it as needed to operate and promote the Platform.

Our liability

To the fullest extent permitted by law, and subject to the consumer rights set out below, BuildersLink is not liable for any loss, damage, cost or claim arising from a job, a dealing between a customer and a tradie, or your use of the Platform, and we are not liable for indirect or consequential loss. Where we are found liable despite this, our total liability to you is limited to the amount of fees (if any) you paid us in the 12 months before the event giving rise to the claim.

Your rights under New Zealand consumer law (customers)

Nothing in these Terms limits or excludes any rights or remedies you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other New Zealand law, that cannot lawfully be excluded. Where you deal with us or a tradie as a consumer, those guarantees still apply, and the limits above apply only to the extent the law allows.

Tradies acting in trade

Tradies use the Platform in trade for business purposes. To the extent permitted by section 43 of the Consumer Guarantees Act 1993 and section 5C of the Fair Trading Act 1986, BuildersLink and each tradie agree that the consumer guarantees and the relevant Fair Trading Act provisions do not apply to the supply of the Platform to that tradie. Because both BuildersLink and the tradie are in trade, the parties agree it is fair and reasonable to be bound by this term. This does not affect a consumer customer's rights against the tradie.

Indemnity

To the extent permitted by law, you agree to indemnify BuildersLink against loss, cost or claim arising from your breach of these Terms, your unlawful conduct, or a job or dealing you enter through the Platform. This indemnity does not apply to the extent a loss is caused by our own breach or negligence, and nothing in it limits your non-excludable rights.

Suspension and termination

You can stop using the Platform and close your account at any time. We may suspend or terminate your access if you breach these Terms or our Code of Conduct, if required by law, or to protect the Platform and its users. Where it's reasonable to do so, we'll give you notice.

Changes to these terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date above, and significant changes will be notified through the Platform. Continuing to use the Platform after a change means you accept the updated Terms.

Governing law and jurisdiction

These Terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction over any dispute relating to them.
